1 General Terms
1.1 Definitions And General Principles
“Approved Driver” means you and any person(s) named in the Rental Agreement as an Approved Driver.
“charge” and/or “fee” means those set out in the Rental Agreement.
“Damage” is any damage occurring to or loss of the Vehicle (including glass, lights and mirrors), and any damage occurring to third party property caused by the Vehicle.
“Rental Agreement” is the agreement signed by you when taking the Vehicle from us and to which these Terms and Conditions apply.
“Rental Period” means the period shown on the Rental Agreement.
“Drive Easy” or “we” is Drive Easy Rent a Car (company number +91 431 4000558) whose registered office is at Drive Easy, #101, Merkondar Complex, No.1.Tolgate, Chennai Main Road, Tichy, tamilnadu, India – 621216.
“Third Party Claim” means any claim made by third parties for death or personal injury or damage to their vehicle or property.
“You” the person who has signed the Rental Agreement.
“Vehicle” is the car, that you have agreed to rent from “Drive Easy” for the agreed duration as set out in the Rental Agreement or any replacement we provide. This includes its keys and all parts and accessories present within the Vehicle from the commencement of the Rental Period.
These Terms and Conditions, the rental document signed by you, and a return record with computed rental
charges together constitute the rental agreement between yourself and “Drive Easy” or the independent “Drive Easy” Licensee.
You rent from us the car described on the rental document, which rental is solely a bailment for mutual benefit.
You agree to the terms below, provided any such term is not prohibited by the law of a jurisdiction covering this rental, which case such law controls.
You also agree that you are not our agent for any purpose; and that you cannot assign or transfer your obligations.
Any change in this rental agreement or our rights must be in writing and signed by an authorized Drive Easy officer. You further agree that we have the right to change these Terms and Conditions from time to time either
upon written notice to you, in paper or electronic form, or upon our posting such changes on the Drive Easy website.
We are “Drive Easy”. We are a registered company in India under company No.528 and our registered office is at #101, Merkondar Complex, No.1.Tolgate, Chennai Min Road, Trichy, Tamilnadu, India – 621 216 .
In accordance with these Terms and Conditions of Hire (‘T&Cs’) we will have the following obligations:
to rent a Vehicle (a car which will be the same as or similar to the vehicle that you specify in your booking) plus any requested accessories to you (being the person named in the Rental Agreement (as defined below) and the person who signs it) for the period of time that is specified in the Rental Agreement and which shall not exceed 28 days (the “Hire Period”).
To provide certain ancillary services with all of our rentals and to offer you other ancillary services or products which are available at an extra cost.
The relationship between you and “Drive Easy” is governed by these T&Cs together with the following documents which, once you have signed or mark the term and condition button ,the Rental Agreement, will form a legally binding contract between us and will govern your use of the Vehicle during the Hire Period:
The booking confirmation email (where you have prebooked your rental online or through our reservation centres);
In case of any conflict between any of the documents comprising the Contract then these T&Cs will take priority.
TO WHOM DO THE RENTAL TERMS AND CONDITIONS APPLY?
These T&Cs will apply to:
You because you are the person who is paying for the rental and any associated costs and you may also be a driver;
Any other driver who is expressly named on the Rental Agreement and who is therefore authorized to drive the Vehicle;
“Referred Driver” means you and any person(s) named in the Rental Agreement as an Approved Driver.
Any person(s) who is not a party to the Rental Agreement cannotenforce anyof our responsibilities under the Rental Agreement.
The following conditions must be fulfilled prior to Drive Easy releasing a Vehicle to you. If you cannot satisfy these requirements when collecting the Vehicle, we reserve the right not to release the Vehicle to you. In these circumstances you will still be required to pay for the Vehicle unless you cancel the booking in the manner set out below. We reserve the right to ask for additional proof of identification where we reasonable consider that documents you provide already produced are not satisfactory, and retain the right to refuse the rental of our vehicles if we are not satisfied
2. Who Can Rent And Who Can Drive?
2.1 Who can rent?
Any person who:
2.1.1. is legally capable of entering into a legally binding contract and is prepared to accept responsibility for the Vehicle throughout the Hire Period; and
2.1.2. has the means to pay for the hire of the Vehicle and any associated coststhat will be accepted by us and

2.1.3. Provides valid identification documents as indicated in the table below so that we can verify their identity and approve them for rental. Documents required.

Utility Bill or Bank Statement that shows your home address (address present in India)
2.1.4 Terms of the Hire and Vehicle Charges
(a) All rates include GST and standard loss or damage cover
(b) The hire will terminate when the vehicle is returned to the Drive Easy rental location specified in the rental agreement.
(c) The vehicle may not be driven outside the territory which is mentioned in the rental agreement
(d) Unauthorized late return will attract a late return charge in addition to the daily rate.
(e) Please phone us before 24 hours if you wish to extend the rental period and if this is possible we will always oblige. Vehicle hire charges are non-transferable. In the event that the hirer returns the vehicle earlier than stated in the agreement, no refund generally applies
2.2 Verifying and approving your identity for rental:
2.2.1 If you live inside the India Verify your identity and home address by using a third party authentication checking system. Depending on
the results of the check we may need you to provide paper-based proof of identity (such as a utility bill or bank statement that shows your home address) that is less than 3 months old on the date you pick up the Vehicle from us.
It may be helpful to have such documentation with you just in case as, if we need such paper based proof of identity and if you can’t provide it when we ask you for it, we won’t be able to hire a Vehicle to you.
Check your accident claims and motor fraud history via a claims and underwriting database. If you pass this check and your identity and home address is successfully verified then we can let you have a hire Vehicle but
if you fail this check we won’t be able to hire a Vehicle to you irrespective of whether your identity and home address is successfully verified.
2.2.2 If you live outside the India
then, when you collect your Vehicle, in addition to photographic ID (ID card or passport) we will ask to submit the (Indian) local proof of your home address (eg., a utility bill or bank statement) proof of return flights (if applicable) and contact details within the India. If you can’t provide such documents when we ask you for them we won’t be able to hire a vehicle to you. Please note that we do not accept cash payment for our Selection range of vehicles. Also if the Provided documents is mismatched, then the 50% will be charged from
your booking amount for processing. If the verification passed, then the booking amount will added with the total rental value.
2.3 Who can drive the Vehicle? (The “Driver”)
The Driver of a Vehicle will be any person who is deemed by us to be authorized to drive the Vehicle because they comply with all of the following requirements:
2.3.1 They are expressly mentioned and fully identified on the Rental Agreement as either the hirer or an additional driver or a Referred Driver;
2.3.2 They have provided a valid driving license and a valid identification document according to the requirements of section 2.2 above; and
2.3.3 They hold a full and valid driving license
In order to drive across India, any NRI from participating State who is visiting for a period less than a year must ensure that they Possess International Driving Permit issued by the country they holds Driving License
of. Such International Driving Permits are issued as per. Countries signatory to it allows License Holders of
Foreign Country to drive in when carrying an International Driving Permit along with their original Driving
License. Also should submit proof of valid Indian License. Such Permits are valid for a period of 1 year from their issuance.
2.3.4 While driving seat belt must for driver and co passengers.
2.3.5 Below 12 years children’s he/she will not allow to sit near the driver seat.
Non-Indian driving license holders:
Must have held a full and valid driving license for a minimum of 12 months. Licenses issued overseas must be
clearly identifiable as a driving license, otherwise an international driving license will be required. In addition
the following documentation must also be provided: (i) Passport; and (ii) proof of entry/exit into/out of the
India (e-tickets acceptable);
2.3.4. They comply with the minimum age requirements will be 24.
2.4. Who cannot drive the Vehicle? (an ‘unauthorized driver’)
2.4.1. Any person that is not expressly mentioned or identified on the Rental Agreement as a Driver (see section 2.3 above); and
2.4.2. Any person who cannot provide valid identification documents as indicated in sections 2.1.3 and 2.2 and 2.3 above.
2.4.3. An unauthorized driver will not be covered by any of the insurance or protection products we offer. Only third party liability insurance (compulsory protection) will apply.
2.4.4. If you allow an unauthorized driver to drive the Vehicle then you are considered to be in breach of the Contract and you will be responsible for any consequences that may arise as a result. This will include compensating us for any damage caused by you and/or the unauthorized driver.
3. Where Can I Drive A Vehicle?
3.1. You must not take our Vehicle (nor permit the Vehicle to be taken) outside mainland India (“the Territory”) without obtaining our prior written consent.
3.2. Where we give you our consent you are responsible for ensuring the Vehicle has the correct equipment to comply with local driving regulations in the country(ies) that you intend to drive in or through. If the Vehicle needs to be modified in any way you must obtain our prior written consent to make the modification and, if we give that consent and the modification of the Vehicle is carried out, you will be responsible for any loss and/or damage caused by the modification. Please be aware that you must comply with all road traffic regulations in the country where you drive the Vehicle and you must ensure that the Vehicle you are driving complies with the local legislation for each country that you may drive in or through.
4. What Type Of Vehicle Can Be Rented And For What Purpose?
You can rent either a passenger car and you must drive the Vehicle in accordance with its intended use as follows:
4.1. Passenger cars with fully automatic are intended for the carriage of varying numbers of people (depending
on the manufacturer’s recommendations);
5. Vehicle Pick-Up
5.1 What You Need To Bring
At the vehicle pick up we will ask you to present a valid method of payment, full valid driving licence and passport/ID/proof of address (please refer 2.1.3)
If you will fail to comply with the requirements, you will not be able to rent the Vehicle with us and you will be treated as having cancelled the booking and liable for a cancellation charge.
5.2 Time Of Pickup
Any changes to your reservation at time of pick-up or anytime during the Rental Period will be by agreement only and may be a subject to a change of the rental rate and may involve an additional charge depending on the type of the booking.In case of selected car model is unavailable, will try it’s best to provide an equivalent car model or upgrade the car with no addition.
5.3 Deposits & Approvals
We may require a security deposit/approval on your payment card. The amount of the deposit may vary depending on the type of the booking, vehicle category or the method of payment.
Debit Card Deposits
The minimum deposit on a Debit Card is applicable plus the estimated rental cost including all additional charges. The deposit amount is immediately debited from the cardholder’s bank account and is held by us until the Rental Agreement is terminated and all rental charges and payments for Damage are cleared. Unless you settle all rental charges on return of the Vehicle you authorise us to allocate the monies held on deposit against such rental charges and Damage. We will refund you any excess held by us.
Credit Card Approvals
The minimum approval amount for credit cards will be determined by multiplying the rental reservation and other relevant charges with a minimum approval amount will be applicable. The approval amount is not immediately debited but held on the cardholder’s bank account until the final rental charge amount has been paid to us. When the Vehicle is returned, the invoiced amount will be charged to the credit card provided, unless you present another form of payment.
5.4 Charges at Pick Up
Your Rental Agreement will show any fees and charges applicable.
5.4.1 Rental Charge
The basic rental charge includes the daily rental charge for the vehicle for number of calendar days of the rental, third party liability insurance, collision damage waiver with excess, breakdown assistance, limited/unlimited mileage (depending on the applicable rate) The charges will be applicable for driving out of Tamilnadu(other state travel) or hill station travel.
5.4.2 Mileage Charge
A mileage charge will be incurred if you exceed any mileage limitation set out in the Rental Agreement.
5.4.3 Can I Pay My Rental With A Foreign Credit Card ?
In some countries and for some credit card types, Drive Easy offers a dynamic currency conversion option to be selected at checkout time only. In such a case, you have the choice at the beginning of the rental to elect to pay in either the currency of the country from which you have obtained the Rental Agreement (INR), or to pay in the currency from which your credit card is registered. If the payment is made in the cardholder’s billing currency, Drive Easy will convert the invoiced amount from the rental currency (INR) to the currency of the cardholder’s designated card. If the dynamic currency conversion is not available, cannot be processed by Drive Easy, or is declined by you at the time of rental, then the transaction will be submitted in the rental currency. The tariffs applicable to the rental, to the additional services and the optional coverage’s or protections are those which are in force on the date of issue of the Rental Agreement, and correspond to your original reservation (vehicle rental type, duration, return branch location). Any change to the Rental Agreement
will use the tariffs in place at the time of the change.
5.4.4 Other Products and Services
The owner agrees to arrange and the hirer agrees to purchase any additional products and services as detailed on the Rental Agreement.
5.4.5 Petrol and Other Fuel
The hirer is responsible for the cost of fuel used during the hire The vehicle must be return with the amount of fuel equal to that at the time of rental. If the vehicle is returned with less fuel the difference will be charged at a rate which may include a service component unless prior arrangements have been made.
5.5 Protection Programme
5.5.1 Third Party Liability
We have a legal responsibility to have Third Party Protection. This provides cover for claims made against you and other Approved Drivers in the event of the death or injury to the other party in an accident (unlimited liability). It also provides cover for damage to their property (depends). You will be responsible for any costs in excess of this in relation to third party damage.
5.5.2 Collision Damage Waivers
We will provide cover for Damage and Third Party Claims during your Rental Period. However, there are damage excess amounts for which you are personally responsible. It is possible to pay an additional amount to lower the value of the damage excess. The amount of your excess which you are liable for is stated on your Rental Agreement.
You are responsible for Damage and Third Party Claims, up to the amount of your excess plus our standard administration fee. You have to pay the amount up to and including the damage excess each time you damage the vehicle or cause loss, plus our standard administration fee. We will not charge you the full amount for Damage and Third Party Claims (unless you breach the Terms and Conditions specified below).
The Collision Damage Waiver will not apply and you will be responsible for all Damage and Third Party
Claims if :
– You breach the requirements of clause 2.3 by allowing anyone other than you and any Approved Drivers to drive the Vehicle;
– You breach the requirements of clause 2.4 by allowing anyone to drive the Vehicle under the influence of any substance specified;
– You breach any of the requirements of clause 6.6.1 of these Terms and Conditions and such breach causes or contributes to the Damage or Third Party Claim; and In respect of Damage only:
– You breach the requirements of clause 6.6.2 by failing to report an accident or incident involving a third party to us within 24 hours
5.6 Vehicle Inspection On Pick-Up
It is your responsibility to inspect the Vehicle for any pre-existing Damage before driving the Vehicle. If you find any, you must tell us before taking possession of the Vehicle. You will be responsible for any Damage not notified to us before taking possession of the Vehicle.
5.6.1 Hirer’s Liability for Cleaning Charges
If the vehicle is returned in an excessively dirty condition that requires extraordinary cleaning or deodorising, the hirer is absolutely liable for the full cost of this cleaning or repair and any consequent loss of use of the vehicle.
Such charges include but are not limited to cleaning of:
(a) Spillage of fluids such as drinks, milk, oil, paint, etc.;
(b) Perishable food;
(c) Removal of hair, stains and odours due to animals in the vehicle;
(d) Fish and associated smells;
(f) Cigarette/cigar smoke smells.
5.6.2 Administration Charges
(i) In the event that the Owner receives an unpaid toll notice relating to the period the vehicle was on hire, the owner will charge the hirer reasonable fee and administration fee for transfer of liability of the notice to the hirer.
5.6.3 Calculation of charges
The owner calculates rental days as the number of consecutive 24-hour periods starting at the earlier of the time the rental was booked to start or the actual start time and finishing at the later of time the rental was booked to finish or the actual finish time. An extra day is charged after allowing a grace period of 1 hour and 59 minutes. Notwithstanding this, clause 4 applies in the case of unauthorised late return.third
5.7 Vehicle Delivery
Where we deliver the Vehicle to you or collect the Vehicle from you, you are responsible for any published rates for delivering and collecting the vehicle.
When we deliver a Vehicle to you, you are responsible to inspect for any pre-existing damage and notify any damage to us prior driving the Vehicle by calling the number for the Drive Easy Support Line noted in the Rental Agreement.
6 During the Rental
6.1 Rental Period
The Rental Period starts on the date and time indicated on the Rental Agreement and ends on the indicated date and time. The Rental Agreement is terminated when a) the Vehicle is returned and its keys are handed over to a Drive Easy employee; placed in a Drive Easy key drop box and b) the vehicle has been inspected and checked by us. If you return the Vehicle before the end of the Rental Period then both the Rental Period and this Agreement will end on the date of the Vehicles return. If you decide to return the Vehicle early you will not be entitled to the return of any unused prepaid Rental Charges.
6.2 Extensions of the Rental Period
The Rental Period may be extended if requested by you before 24 hours.. If we agree to an extension we may require an additional deposit, together with the relevant method of payment for the extended Rental Period. Drive Easy will not agree an extension which means that the Rental Period will exceed 28 days. If you require a vehicle for longer than 28 days, you must return the Vehicle under this Rental Agreement prior to the expiry of such period and enter into another Rental Agreement for the additional period
6.3 Our Responsibilities
Drive Easy will:
Maintain the Vehicle to its manufacturer’s recommended standard. Ensure the Vehicle is roadworthy and suitable for driving at the commencement of the Rental Period.
6.4 Your Responsibilities
6.4.1 Towards The Vehicle
You are responsible for the Vehicle and for any Damage during the Rental Period. During the Rental Period you will use the Vehicle in accordance with good driving practices and in compliance with all laws relating to the Vehicle.
You or any Approved Driver must ensure that
The vehicle is protected against bad weather which may cause damage
The vehicle is not used for pushing or towing other vehicles.
No flammable or dangerous goods, as well as toxic, corrosive, radioactive, or other harmful substances which are illegal or may cause harm to the passengers are transported
The vehicle is not used to transport any items that have a strong smell or are likely to affect or harm the vehicle in a way that might cause a loss of time or money because the vehicle needs to be repaired or prepared back to its original state after the rental.
The vehicle is not driven or used on roads that could harm the vehicle’s wheels, tyres or undercarriage, leading to necessary repairs
The right kind of fuel is used for the vehicle
The vehicle is not driven through spaces which are too narrow for the vehicle
The vehicle is not harmed by unsecured loadings or hitting high-level objects
The vehicle is not rented, sold or disposed of or any of its parts.
Only you or an Approved Driver drives the Vehicle Damage to the tyres, e.g. blow-outs, punctures, flat tyres, and tears in the rubber is avoided.
The Vehicle is not used for racing, off roading, speed testing, driving instruction The Vehicle is not used for any illegal purpose, or in an unreasonable nor negligent manner.
That you will not nor will you allow anyone else to smoke in the Vehicle.
You will not sell, rent or dispose of the Vehicle or any of its parts or Accessories.
You will not attempt to nor give anyone any legal rights over the Vehicle.
You will not modify the Vehicle
You do not overload the Vehicle
You do not use the Vehicle whilst under the influence of alcohol, drugs, and medications or if you may
reasonably be considered to be unfit to drive a vehicle
You do not use the Vehicle for carrying fare-paying passengers unless we have expressly given you consent.
6. 4.2 Towards Drive Easy
You must notify Drive Easy as soon as possible of any fault in or Damage to the Vehicle
You must notify Drive Easy as soon as possible (and in any event within 24 hours) of any accident or incident involving a third party whether or not you are aware of any Damage.
6.4.3 Traffic Rule Violation
Cost for any traffic rule violation during the Rental Period will be borne by the hirer directly. In cases, where challans is received by the Company via post upon completion of the Agreement, the hirer authorizes the Company to charge the same. The User shall follow all the rules and regulation under applicable laws while driving the Vehicle and otherwise including applicable speed limits.
6.4.4 Replacement Car
Replacement Vehicle shall be provided within a city limits only (Subject to availability of similar segment in the city) in all such cases where in a Vehicle develops mechanical error and restrain the User from its use. In a case, where in Vehicle develops such error outside the city limit, replacement Vehicle will not be provided and amount equivalent to agreed rental will be charged. 6.5 Fines, Penalties & Tolls
You are responsible for all fines, penalties and tolls levied against the Vehicle during the Rental Period. Where Drive Easy pays any fines, penalties or tolls on your behalf, Drive Easy may recharge you the cost of the same together with an administration fee to cover the additional processing cost.
For the duration of the Rental Period the Vehicle will have the benefit of our Drive Easy Support Line. In order to benefit from the breakdown service you will need to call the number for Drive Easy Support Line set out on the Drive Easy Website or Rental Agreement or Drive Easy website. If the vehicle breaks down during the Rental Period we will, as soon as possible, recover and repair the Vehicle. If the Vehicle cannot be repaired we may provide a replacement vehicle (refer clause 6.4.4) , subject to availability and circumstances.
If the breakdown is caused by your negligence, fault or by that of an Approved Driver or arises as a result of a breach of the Rental Agreement you will be responsible for the full cost of the repair and recovery plus an administration fee for handling the claim and any other associated costs.
If you have purchased our Roadside Protection package, in addition to the above you are covered for the
Putting in the wrong fuel provided the Vehicle has not been driven afterwards
If the Vehicle runs out of fuel
Loss or locked-in keys
Damage to the clutch
Towing and recovery charges
The Roadside Protection package does not include the cost of any replacement parts or labour for fitting these parts and any damage done to the vehicle not covered above or the admin fee for handling any claim.
In case of an accident or any incident relating to the Vehicle you must:
1. Not admit or accept liability.
2. Obtain and notify us of all the names and addresses of all involved parties, including witnesses.
3. Secure the vehicle and inform the police right away if anyone is injured, the road is blocked or if any property has been damaged.
4. Call the number for the Drive Easy Support Line on the Rental Agreement or Drive Easy Website.
6.7.1 24h-Drive Easy Drive Easy Support Line
In the case of an accident with a Third Party, the Drive Easy Support line must be contacted within 12 hours of the accident by calling the number for Drive Easy Support line set out on the Rental Agreement or Drive Easy website. In the event of confiscation or impounding of the vehicle by third parties, you must inform us immediately by email to email@example.com.
In the event of theft of the Vehicle the Rental Agreement will be terminated as soon as Drive Easy has received a copy of the theft declaration made by you to the police authorities. Drive Easy has no responsibility for loss, theft, robbery, or damage of any objects transported or left in the Vehicle.
6.8 Maintenance & Repair
You must not let anyone work on the Vehicle without prior permission in writing from Drive Easy. Where Drive Easy grants the permission, we will only provide you with a refund where you provide us with a valid GST receipt for the work carried out. If no permission is granted Drive Easy will collect the Vehicle and carry out any necessary repairs.
During the Rental Period you are responsible for carrying out usual maintenance checks (e.g. engine oil / tyre pressure) that would be expected of any regular vehicle owner.
If an instrument panel warning sign becomes illuminated or you become aware of any mechanical or other problems with the Vehicle you must not drive the Vehicle until the cause of the fault has been remedied and must call Drive Easy Support line the number for Drive Easy Support line set out on the Rental Agreement or
Drive Easy website.
If the odometer stops functioning for any reason other than a mechanical failure you will be required to pay an unlimited mileage surcharge in accordance with our standard charges at the time.
7. Time of Return
At the end of the Rental Agreement you must return the Vehicle to the place stated on the Rental Agreement.
You must return the Vehicle to us in the same condition as it was at the stat of the Rental Period (subject to fair
wear and tear).
7.1 Returns Procedure
7.1.1 Vehicle Inspection on Return
We will inspect the Vehicle on its return for any new Damage or changes in condition from those described on the Rental Agreement at the time of the Vehicle pick up or which you notified to us in accordance with the provisions in paragraph 5.6. If you are unable or refuse to complete the inspection with us, we will inspect the
Vehicle in your absence. Some Damage may not be apparent at the post-rental inspection, such as mechanical damage (the engine, fuel tank or clutch) or hidden damage by adverse light or weather conditions. If we find any such Damage we will notify you with evidence of the same.
7.1.2 Out of Time – Return
If you return a Vehicle outside branch opening hours you will remain liable for any Damage caused to the Vehicle until a Drive Easy employee takes possession of the Vehicle.
7.1.3 Failure To Return
If the Rental Period is ended and the Vehicle is not returned within 2 working hours we may repossess the Vehicle. If we repossess the Vehicle, you must pay any reasonable expenses and costs involved in our doing so. If we have the right to repossess the Vehicle you give us permission (and cannot withdraw it) to access your premises to do so so long as we do not use unreasonable force or cause damage.
Where necessary we may apply to the Court for an order requiring you to return the Vehicle and/or pay Drive
Easy the Vehicle’s market value. Alternatively we reserve the right to charge you for each day (whether in part or full) from the date when you should have returned the Vehicle to us to the date when you do return the Vehicle. The rate we will charge will be the standard daily rental rate, applicable at that time for the relevant location. Your obligations in relation to the Vehicle continue until you return it to us notwithstanding that the Rental Period may have come to an end.
7.1.4 One Way Repatriation
You agree to return the Vehicle to the branch specified in the Rental Agreement. If the Vehicle is returned to an alternative location then you will be liable for any reasonable costs to relocate the Vehicle to location specified in the Rental Agreement.
If you return the Vehicle before the return date and time stated on your Rental Agreement then the Rental Period will end when you return the Vehicle and the keys to a Drive Easy agent. You will not be entitled to the return of any prepaid rental charges. If you have not prepaid any rental charges, the daily rate applicable for the Rental Agreement will be our standard rate based on the shorter Rental Period and additional charges which may be higher than your original quoted daily rate.
7.1.6 Time of Vehicle collection
If we are to collect the Vehicle and key from you it must be parked in a suitable place to allow collection without the imposition of any fines or penalties. The end of your Rental Agreement is defined by handing over the keys to a uniformed Drive Easy employee on collection at your premises.
8. After Rental period
You agree that Drive Easy invoices will be sent electronically to the designated invoice recipient. Drive Easy will send an electronic invoice to the e-mail address which you have provided. You are responsible for being able to receive electronic invoices or, if agreed accordingly, to collect them electronically. You are accountable for malfunctions of the receiving devices or any other circumstances that hinder access to the invoices. An invoice is received as soon as it enters your domain. If Drive Easy sends a note and the hirer is able to retrieve the invoice on their own accord, or if Drive Easy makes the invoice available for retrieval, then the invoice is received when it was retrieved by the hirer. You are accountable for retrieving the invoices in reasonable intervals. If an invoice is not received or cannot be received, you shall notify Drive Easy immediately. In this case, Drive Easy will re-send a copy of the invoice and designate it
“Copy”. If the malfunction and the possibility of transfer cannot be resolved promptly, Drive Easy may send paper invoices until the malfunction has been resolved. Drive Easy will bear the costs for the consignment of paper invoices in this case. If Drive Easy provides you with login data, a user name or password then unauthorized access must be prevented and the data kept strictly confidential. In the event that you discover unauthorized persons may have gained access to this information, then you shall notify Drive Easy immediately.
8.2 Lost Property
8.2.1 During the rental we are not responsible for any property in the Vehicle during the Rental Period which is there at your own risk.
8.2.2 After the rental you must not leave any property in the Vehicle when you return it to us. If you have left items in the Vehicle, we may agree to keep them for you to collect within a reasonable time and we may charge you a reasonable fee for storing the item(s). Any property left in the Vehicle which remains unclaimed 3 months after the end of the Rental Period will be disposed of.
As you are responsible for the Vehicle during the Rental Period, if any Damage has occurred during the Rental Period, you will be responsible to compensate us for that Damage. If you return a Vehicle outside branch opening hours you will remain liable for any Damage caused to the Vehicle until a Drive Easy employee takes possession of the Vehicle.
You are only responsible for Damage up to the amount of your damage excess plus our standard administration fee (stated below), unless you breach the Terms and Conditions in section 2.3,2.4, 6.4.1 and/or 6.4.2 specified above, in which case the Collision Damage Waiver shall no longer apply and you shall be responsible for all the Damage and the administration fee.
The amount of compensation payable to us for any Damage will be calculated on the basis stated below.
We will calculate the compensation due to us for any other Damage by asking an appropriately qualified expert to provide an estimate of our losses resulting from the Damage and such losses will include the reasonable fees charged to us by that expert. The expert will base that estimate on the reasonable cost of the repairs to the
Vehicle necessary as a result of the Damage. The estimate is intended to reflect the loss measured by the open market rate of repairs to the Vehicle at an appropriate dealership or authorized repair center of the Vehicle.
This estimate does not necessarily reflect the actual cost of repair if the Damage is repaired.
If we believe that you are responsible for Damage, we will notify you as soon as possible of the appropriate amount due as set out above.
If you disagree with the expert’s estimate of the losses resulting from the Damage, you may instruct your own expert (at your own cost) and we will allow you and/or your expert to access the evidence of the Damage in our possession. If we cannot agree with you the amount due in respect of the Damage, it may be necessary for a court to decide on the appropriate payment.
Cancellation charges will be applicable when If you cancel the booking Prior to 24 hours, 50% cancellation charge will be applied on the total deposit
In case of a “NO SHOW” or if booking is cancelled at or after pick up time, no refund will be provided.
10 Privacy Act
The information requested from the hirer is to enable the owner to assess the hirer’s request to hire a vehicle.
The hirer does not have to supply this information, but if the hirer does not, then the owner is unable to hire the vehicle. The hirer acknowledges that the owner will collect, hold and use the hirer’s personal information for purposes related to the hire of the vehicle and the provision of related customer services, including direct marketing and assessing customer satisfaction with products and services provided by the owner. The hirer further acknowledges that such personal information may be disclosed to debt collection agencies in the event that the hirer defaults in the payment of any monies owing to the owner, or other parties involved in an accident with the vehicle while on hire to the hirer; or any organizations responsible for the processing or handling of traffic related infringements; and the hirer hereby authorizes the disclosure of their personal information for such purposes.
The vehicle must be returned with the amount of fuel equal to that at the time of rental.
